U.S. Customs and Border Protection (CBP) announced that penalties will be imposed beginning February 1, 2009 for failure to comply with the U.S. Bureau of Census’ mandatory AES regulations.
CPB may penalize the U.S. Principal Parties in Interest, Foreign Principal Parties in Interest, freight forwarders, authorized agents, brokers, carriers and other parties to the export transaction.

Exporters may be required to report shipment details electronically in AES prior to cargo loading on board a vessel for export from the U.S.
Exporters must provide "K" Line with the proof of filing (ITN), exception or exemption legend for all bookings by the established cut-off.
"K" Line’s SCAC for AES is KKLU.
"K" Line may be penalized for loading non-compliant cargo, therefore, cargo that is missing the proof of filing citation, exemption or exception legend by the established cut-off will be rolled. Cargo that is on-dock and rolls due to late or missing proof of filing citation or exemption legend will be subject to a $200 administration fee plus all associated charges as per applicable tariff.
